Akane KUBO, in her capacity as data controller, undertakes to ensure that the collection and processing of personal data of natural persons, carried out from the website www.lilica-textile.com (hereinafter referred to as the Site) complies with the Data Protection Act of 6 January 1978, amended by Law No. 2004-801 of 6 August 2004 on the protection of individuals with regard to the processing of personal data, and European Regulation 2016/679 of 27/04/2016 relating to the protection of personal data.

 

As part of this commitment, Akane KUBO has established a Privacy Policy to provide you with all the information relating to our practices in terms of the collection, use and disclosure of information concerning you, obtained through the Site.

 

This policy only concerns data relating to natural persons.

 

By using the Site, you agree to the collection, use and disclosure of your personal data in the manner set out in this Privacy Policy. 

 

In the event of amendments or updates, the updated Privacy Policy will be uploaded onto our Site, indicating the date of the latest update.

What personal data is collected on the Site?

 

The personal data that we are likely to collect and process includes:

What are the purposes of collecting your personal data on the Site?

 

Your personal data is collected, depending on the case, either on the basis of your explicit consent, or on the basis of the execution of a sales contract.

Who are the recipients of your personal data?

 

Your personal data is collected and processed by Akane KUBO. It is hosted and stored on the servers of the Company Wix.com Ltd., located in the United States of America, Ireland, South Korea, Taiwan and Israel.

 

Wix is based in Israel, which is considered by the European Commission to provide an adequate level of protection for personal data of residents of EU member states.

 

Under the terms of its privacy policy, available at https://en.wix.com/about/privacy, Wix indicates that its affiliates and third party service providers who store or process personal data on behalf of Wix contractually agree to protect and secure it, in accordance with industry standards and regardless of any lesser legal requirements that may apply in their jurisdiction.

 

Furthermore, your personal data will not be transferred or made accessible to any third party, except for any of Akane KUBO's subcontractors for exclusively technical and logistical reasons (in particular the hosting and maintenance providers of the Site, the payment and fraud management service providers, and mailing service providers); 

 

In addition, Akane KUBO may need to use connectors developed by third-party entities, which may be recipients of personal data when you use them.

 

Finally, Akane KUBO may be required to communicate your personal data to third parties when such communication is required by law, regulatory provisions or a court decision, or if this communication is necessary to ensure the protection and defence of her rights.

 

What is the storage period for your personal data?

 

Akane KUBO undertakes to use personal data only for the period of time necessary to achieve the purposes of the collections:

 

  • the data relating to your orders will be available on your customer account as long as it remains active. 

 

  • as soon as your customer account is closed, your personal data will be archived for accounting and probationary purposes for three years from the end of the commercial relationship. 

 

  • your bank details will be kept securely for the time necessary to validate and pay for your order.

 

  • identification data for the purpose of sending newsletters and other communications relating to the LILICA TEXTILE brand will be kept for a period of three years from its collection or from your last contact with the Site (for example, a request for documentation or clicking on a hyperlink contained in an email).

 

  • the personal data relating to your customer account will be kept as long as it remains active. 

 

In the event of extended inactivity on your part for a period of 3 years, your account will be deactivated.

 

At the end of this three-year period, we will contact you again to find out whether or not you wish to:

 

  • continue to receive newsletters and other publications from the LILICA TEXTILE brand;

  • keep your customer account on the Site. 

 

Your data will be destroyed within a maximum period of 2 business days following your request to unsubscribe.

 

In any event, you have the option at any time to close your account and/or unsubscribe from newsletters by contacting our customer service by email at hello@lilica-textile.com, or by clicking on the unsubscribe link attached to each newsletter.

 

  • copies of communications exchanged with our Customer Service may also be kept for archiving purposes.

 

  • Orders and invoices for an amount greater than 120 euros will be kept for 10 years, including 8 years in an archive database; 

 

  • the connection logs collected, subject to your agreement, in the context of cookies and other trackers set up on our Site, will be kept in accordance with the applicable regulations for a period not exceeding thirteen (13) months.

What security measures are taken by Lilica Textile?

 

Akane KUBO commits to the Site's users and her Customers to put in place the appropriate technical and organisational measures to ensure the confidentiality and security of your personal data, in particular by: 

 

  • implementing physical and electronic backup procedures for data collected on our Site;

 

  • setting up a secure consultation of personal data by means of the implementation of a password policy with a complex structure;

 

  • protecting by means of an SSL encryption process all financial information that you provide on the Site to place orders.

 

Despite the measures taken by Akane KUBO, all information communicated online can potentially be intercepted and used by people other than the intended recipient.

 

What are your rights regarding personal data?

 

In accordance with the regulations in force in terms of personal data, any natural person who transmits personal data to Akane KUBO via the Site has the right to access and rectify personal data, as well as the right to request its erasure, to oppose its processing and to obtain its limitation or portability insofar as this is applicable. 

 

Any natural person who transmits personal data can provide instructions regarding the retention, erasure or communication of their personal data after their death.

What about potential claims?

 

This Privacy Policy is governed by and interpreted in accordance with French law. 

 

The French courts have territorial jurisdiction over any dispute relating to the Site, with the exception of special jurisdiction rules, particularly in the event of a dispute with a consumer.
